Know your rights

In brief, an employer must pay all non-exempt employees covered by the Fair Labor Standards Act overtime pay for hours worked over 40 in a workweek at a rate not less than time and one-half (1.5x) their regular rates of pay. An employee cannot “opt-out” or “contract out” of this requirement. Exempt employees include, “executives”, “professionals” and “administrators”. Stated another way, if a non-exempt employee works 50 hours a week at a standard rate of $10.00 per hour, their employer must compensate them $400.00 (40 hours x $10.00 per hour) + $150.00 (10 hours x $15.00 ($10.00 x 1.5)) for a total of $550.00.
